Effective upon enquiry for any services by Jackie of All Trades (Barkedclub)
|
By contacting Jackie of All Trades (Barkedclub) to enquire about any services, you acknowledge that you have read, understood, and agree to the following Terms & Conditions. |
1. Assumption of Risk
Dog training and behaviour modification involve physical activity and interaction with animals and people. The client accepts all inherent risks of injury, property damage, or loss to themselves, their dog(s), or third parties, whether occurring on-site or off-site.
2. Release of Liability
The client releases and holds harmless Jackie of All Trades (Barkedclub), its owner(s), employees, and contractors from all claims, demands, damages, or legal actions arising from participation in training, except in cases of proven gross negligence or intentional misconduct.
3. Client Responsibilities
The client is responsible for the safety, behaviour, and handling of their dog(s) at all times. All training instructions must be followed. Failure to do so may increase risk and reduce training effectiveness.
Training Follow-Through & Progress Reporting
The effectiveness of training depends on the Guardian’s consistency and accuracy in implementing the training plan between sessions. The Guardian agrees to provide video updates demonstrating their dog’s current training level and the Guardian’s technique.
- Each update must be a video of up to one (1) to two (2) minutes
- The video must show both the dog’s behaviour and the handler’s technique
- A minimum of three (3) videos must be submitted per week on all paid programmes
- Updates must be submitted as requested by the Trainer
These videos are required for the Trainer to assess progress, identify errors, and safely advance training plans. Failure to submit updates may prevent the Trainer from verifying progress and may result in training being paused, slowed, or restricted for the welfare and safety of the dog.
4. Photography & Video
- The client consents to the trainer taking photos or videos during sessions for educational, marketing, or promotional use. (client may request for privacy) (optional)
- The client may not record, distribute, or publish images or videos of the trainer without written consent.
5. Intellectual Property
All training plans, videos, handouts, and materials remain the intellectual property of Barkedclub and may not be copied, shared, published, or monetised without written permission.
6. Session Timing & Treats
- Late arrival does not extend session time.
- Treats are the client’s responsibility.
- If the trainer provides treats, allergies and dietary restrictions must be disclosed in advance.
- Sessions are not replaced or postponed due to missing or unsuitable treats.
7. Cancellation & Rescheduling Policy
- Minimum notice: 24 hours (48 hours for weekend sessions)
- Late cancellations forfeit the session
- Maximum two (2) reschedules per month
- Additional reschedules incur a 10% surcharge (weekday) or 20% surcharge (weekend), plus 10% for each further change
- All payments are non-refundable
Homework-Based Session Forfeiture
Separate from cancellation, a session may be forfeited due to lack of training engagement as follows:
- Daily check-ins are required on all paid programmes (Assessment excluded).
- If there is no update for four (4) consecutive days without prior notice to the Trainer, the Trainer will send a prompt.
- If no response is received within that same week, the following session is forfeited. The Trainer cannot prepare or conduct a meaningful session without information on the dog’s progress.
- If the client communicates in advance that they will be away or unavailable, and confirms they will follow up within the same week, the forfeiture rule is paused for that period.
- Forfeited sessions under this clause are not eligible for refund or reschedule.
|
Note: Forfeiture under this clause is independent of the cancellation policy. A session may be forfeited due to homework non-compliance even if it has not been formally cancelled. |
8. Programme Structure & Pricing

Mixed Package Definition
A “Mixed” package consists of exactly two (2) weekday sessions and two (2) weekend sessions per month. This composition is fixed and cannot be varied. Clients who wish to book a different split must select the Weekday or Weekend package and will be charged accordingly.
Follow-Up Programme
Clients who have completed a 1-Month or 3-Month In-Person Training programme are eligible for a 10% discount on their next in-person programme. This discount applies for the lifetime of the client relationship and does not expire. It applies to in-person programmes only and is not available on Assessment or Online Consult bookings.
If the Trainer determines that the client’s goals or the dog’s behaviour have changed significantly since the last programme, a new Assessment may be recommended prior to commencing a Follow-Up Programme.

- 3-Month In-Person Training: all sessions must be used within 90 days of the first session.

9. For Rescuers, Fosterers & Trial Adopters
- Credits may be transferred once only, with a 10% administrative fee.Transfers do not reset expiry dates. The new guardian becomes fully bound by all Terms & Conditions.
Barkedclub works with adopters directly and operates under the following conditions when a rescue or fosterer is involved:
- The adopter is the sole point of contact for all training-related communication. Rescuers and fosterers are not included in case correspondence.
- Payment must come from the adopter. Barkedclub does not accept session fees paid by a rescue or third party on the adopter’s behalf.
- Barkedclub will not assess a case as a match simply because a placement has already occurred. If a dog and home are assessed as incompatible, that assessment will be communicated honestly.
- Training outcomes are the adopter’s responsibility. Barkedclub does not motivate, chase, or carry adopters through the training process.
- Barkedclub will not provide case updates, progress reports, or any client information to the rescuer unless written consent has been provided by the adopter.
- If an adopter uses training as grounds to return a dog, this is not a reflection on the trainer. Barkedclub will not be held responsible for rehoming outcomes.
10. Age Requirement (Human)
Training services are available to adults (18 years of age or older) only. Direct training is not provided to individuals under the age of 18. After completing an initial period of sessions with an adult handler, the trainer may support that adult in providing direction to minors under their supervision. All direct coaching and instruction will be conducted exclusively with the adult handler.
11. Punishment-Free Training & Fee Forfeiture
Barkedclub uses positive reinforcement and punishment-free training only. Use of aversive or punitive methods by the client may result in immediate termination of services and forfeiture of all prepaid fees.
12. Bite History Disclosure, Risk Fees & Rehoming Requests

- Who was involved
- What happened
- When and where
- Trigger
- Skin contact
- Injury severity
Failure to disclose is a material breach and may result in termination and forfeiture of all prepaid fees.
Dogs with bite or snap history may incur a risk handling fee of RM50 or more per session, based on severity and safety requirements.
Barkedclub does not provide rehoming, surrender, rescue, or placement services. Requests for such assistance are prohibited.

If the Guardian fails to submit required video updates, does not follow the training plan, or demonstrates inconsistent or incorrect implementation, Barkedclub may, at its professional discretion:
- Decline to progress to new exercises
- Restrict sessions to foundational work only
- Slow or pause the training plan
- Refuse to work on higher-risk behaviour until compliance improves
Any stagnation resulting from lack of follow-through shall not be considered trainer failure or grounds for refunds, rescheduling, or fee reduction.
21. Agreement Upon Enquiry
By enquiring about any services with Jackie of All Trades (Barkedclub), the client, rescuer, fosterer, or guardian is deemed to have accepted and agreed to all Terms & Conditions contained herein, whether or not a booking or payment has yet been made. Once payment is made, these Terms remain fully binding unless an exception is made in writing by Jacqueline Benita of Barkedclub.
22. Indemnity
The person agreeing to these terms is the designated handler for the training session. The designated handler is the adult who books and attends the training sessions and is solely responsible for all decisions made during and after those sessions.
By accepting these terms, the designated handler agrees to indemnify and hold harmless Jacqueline of Barkedclub against any claims, losses, damages, or liability arising from or in connection with the training sessions, including any direction given to minors under their supervision.
This indemnity applies solely to the designated handler and may not be assumed, transferred, or accepted on their behalf by any other person.
